1. Acceptance and Scope
By registering, accessing, or using Eagle Eye (the “Application” or the “App”), the user freely and expressly agrees to these Terms of Use and represents that they are fourteen (14) years of age or older. If the user does not agree with any provision herein, they must refrain from using the Application.
Eagle Eye is a technological civic collaboration platform that allows users to report, view, and receive real-time alerts related to safety, infrastructure, mobility, and other relevant urban events.
Use of the App implies full acceptance of these Terms as well as the applicable Privacy Policy.
2. Nature of the Service
The Application provides a digital environment that enables the publication and consultation of user-generated content, including audiovisual material, textual descriptions, and approximate location data of reported events.
Eagle Eye does not constitute an official emergency service and does not replace competent authorities. Information available within the App may originate from third parties and does not constitute a guarantee of accuracy, reliability, availability, or timeliness.
Users acknowledge that they access and rely on such information at their own discretion and risk. Eagle Eye does not automatically share reports with police, fire departments, emergency medical services, law enforcement, or government entities, except where legally required or upon valid request from a competent authority.
3. Device Permissions
For proper operation, the Application may request access to certain device features, including camera, microphone, geolocation services, and push notifications. These permissions are requested explicitly and may be revoked at any time through the device settings.
The Application does not access or process information beyond what is necessary for providing its services.
4. Monthly Auto-Renewable Subscription
Certain functionalities of Eagle Eye may require a monthly auto-renewable subscription managed exclusively through Apple App Store or Google Play.
The subscription period is one (1) month and renews automatically unless canceled prior to the renewal date. Billing occurs monthly and in advance through the payment method registered with the respective app store.
Cancellation must be performed through the user’s account in the corresponding digital store. Cancellation prevents renewal for the next billing cycle but does not entitle the user to refunds for the current billing period, unless otherwise determined by the app store’s policies.
5. User Responsibility and Rules of Conduct
Users are solely responsible for the content they publish within the Application. By submitting a report, users represent that they have the necessary rights to share such content and that its publication does not infringe the rights of third parties or violate applicable laws.
Users agree to use the Application responsibly and not to publish unlawful, defamatory, misleading, or harmful content.
In particular, users may not publish content that:
- contains threats, violence, intimidation, or hate speech;
- is offensive, abusive, harassing, or intimidating toward others;
- includes deliberately false information intended to cause alarm, misinformation, or harm;
- constitutes spam, fraud, impersonation, or misuse of the platform;
- violates the law, privacy, image, or rights of third parties;
- improperly exposes victims, minors, or vulnerable persons.
Eagle Eye maintains a zero-tolerance policy toward objectionable content and abusive conduct.
6. Reporting, Moderation, and Suspension
The Application includes mechanisms for reporting content that may be inappropriate or inconsistent with these Terms. When a user reports an event, Eagle Eye may record the report, mark the content as reported, limit its visibility, and notify the moderation team for review.
Additionally, the App may allow the reporting user to stop receiving content from the same account that originated the reported event, without publicly disclosing the identity of that account.
Eagle Eye reviews content reports within a maximum period of twenty-four (24) hours and may take one or more of the following actions where appropriate:
- remove or unpublish the reported content;
- temporarily suspend the responsible account;
- permanently terminate access for the offending user;
- preserve evidence and cooperate with authorities where legally required or formally requested.
Content may be removed without prior notice when necessary to protect third-party rights, preserve community safety, or comply with legal obligations.
7. Reporter Anonymity
Eagle Eye does not publicly disclose the identity of users who submit reports. Visible information within the platform is limited to the reported content, approximate location, and report date.
However, each publication is internally associated with an account or technical identifier that allows Eagle Eye to manage reports, moderation, content filtering, and enforcement actions under these Terms.
8. Data Protection
Personal data processing is carried out in accordance with applicable Colombian regulations, including Law 1581 of 2012 and Decree 1377 of 2013. Use of the Application implies acceptance of the Privacy Policy.
9. Limitation of Liability
Eagle Eye shall not be liable for direct or indirect damages arising from the use of information published by third parties within the platform. Users acknowledge that they use the Application at their own risk.
The App does not guarantee that reported events will result in intervention by any authority or that any reported situation will be addressed, resolved, or verified by official entities.
10. Governing Law
These Terms are governed by the laws of the Republic of Colombia. Any dispute shall be submitted to the competent authorities of that jurisdiction.
